Artikel 1053 - Zelfstandigheid van de overeenkomst tot arbitrage
Translation De overeenkomst tot arbitrage dient als een afzonderlijke overeenkomst te worden beschouwd en beoordeeld. Het scheidsgerecht is bevoegd, te oordelen over de rechtsgeldigheid van de hoofdovereenkomst waarvan de overeenkomst tot arbitrage deel uitmaakt of waarop zij betrekking heeft.

Article 1053 - Separability of the arbitration clause
Original An arbitration agreement shall be considered and decided upon as a separate agreement. The arbitral tribunal shall have the power to decide on the validity of the contract of which the arbitration agreement forms part of or to which the arbitration agreement is related.
